1. Acceptance of Terms
By accessing www.lighthousecoffeemercantile.com (“Site”), visiting our café at 901 S. Maiden Ln, Joplin MO 64801, or purchasing any product or service from Lighthouse Coffee & Mercantile (“Lighthouse,” “we,” “us,” “our”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not use the Site or our services.

2. Changes to Terms
We may modify these Terms at any time. Updated versions will be posted with a new “Last updated” date. Continued use after changes constitutes acceptance of the revised Terms.

3. Orders, Pricing, and Payment

All prices are listed in U.S. dollars and are subject to change without notice.

We reserve the right to refuse or cancel any order at our sole discretion.

Online transactions are processed through third-party payment providers; we never store full credit-card numbers.

Missouri sales tax (and any applicable local tax) will be added where required.

4. Refunds and Returns

In-Café Purchases: If you are not satisfied with a beverage, let us know during your visit and we will remake it or issue a refund at our discretion.

Retail Merchandise: Unworn, unwashed items may be returned within 14 days of purchase with receipt for exchange or store credit.

Gift cards are non-refundable and cannot be redeemed for cash except as required by law.

5. Allergens and Dietary Information
Our products may contain or come into contact with milk, eggs, wheat, soy, tree nuts, peanuts, and other common allergens. We do not guarantee that any item is allergen-free. Patrons with food allergies consume at their own risk.

6. Intellectual Property

All content on the Site—including logos, trademarks, photos, graphics, text, and recipes—is owned by Lighthouse or its licensors and protected by U.S. and international intellectual-property laws.

You may view, print, or download content for personal, non-commercial use only.

Any other use (including reproduction, distribution, or modification) requires prior written consent.

7. User Conduct
You agree not to:

Violate any applicable law or regulation;

Post or transmit any defamatory, obscene, or infringing content;

Interfere with or disrupt the Site or its servers;

Attempt to gain unauthorized access to any portion of the Site or customer data.

8. Wi-Fi Usage
Free in-store Wi-Fi is provided “as is.” By connecting, you agree not to use it for unlawful purposes or to transmit malicious software. We are not liable for data loss or security breaches arising from Wi-Fi use.

9. Third-Party Links
The Site may link to external sites such as DoorDash, Grubhub, or social-media platforms. We are not responsible for the content, policies, or practices of third-party sites.

10. Disclaimer of Warranties
Services and products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties—express or implied—including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

11. Limitation of Liability
To the maximum extent allowed by law, Lighthouse shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, our café, or our products—even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid us in the three months prior to the event giving rise to the claim.

12. Indemnification
You agree to indemnify, defend, and hold harmless Lighthouse and its owners, employees, and agents from any claim or demand—including reasonable attorneys’ fees—arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.

Any dispute not resolved informally shall be submitted to binding arbitration in Jasper County, Missouri, under the Commercial Arbitration Rules of the American Arbitration Association. Judgment on the award may be entered in any court of competent jurisdiction.

Notwithstanding the foregoing, either party may seek injunctive relief in a state or federal court in Missouri to protect intellectual-property or confidential information.

14. Termination
We may suspend or terminate your access to the Site or our services at any time for any reason, including violation of these Terms. Sections 5–13 will survive termination.

15. Entire Agreement
These Terms, together with our Privacy Policy and Accessibility Statement, constitute the entire agreement between you and Lighthouse regarding the Site and our services, superseding any prior agreements or communications.
